PREAMBLE AND SCOPE

These Terms govern exclusively Socialeat Customer and the consumer web features. They do not govern the services dedicated to restaurateurs or the commercial contracts with them.

2. Minimum age and capacity

Socialeat Customer is reserved for users who are at least 18 years old. By registering, the User declares that they have the capacity necessary to use the Service.

Socialeat may adopt reasonable checks and restrict/close accounts when reliable indications of non-compliance with the requirement emerge.

3. Registration, account and security

4. Features of the Service

5. Creation of events and responsibility of the Host

The Host is responsible for the accuracy of the event information, including date, time, place, seats and description.

The place may be a restaurant or a simple address/point of interest recognised by the map service. The Host must avoid the unauthorised publication of private addresses of third parties and carefully assess the use of residential addresses.

The Host automatically joins the event chat and may use the organisational powers provided for.

6. Co-Host

7. Follow Host and follower notifications

Following a Host is for receiving updates on the new events they organise, not on their normal personal activity.

In multi-Host events, Socialeat may notify the combined set of followers, avoiding duplication for the same event.

8. Follow Restaurant

Follow Restaurant enables exclusively the categories of updates provided for, such as new promotion and new table. It does not create a Match or a private chat.

9. Bookings and the 4-hour rule

10. The 8-hour reminder

Eight hours before a booked event/table, Socialeat may send a notification and show an operational pop-up that asks for confirmation of participation or for cancellation.

If the booking is made when less than eight hours remain, the system may adapt the reminder according to the flow shown in the app.

11. Waiting List

Placement on the waiting list does not guarantee a seat. When a seat becomes free, interested users may be notified. The seat goes to the first person who successfully completes the booking, in compliance with the other applicable rules.

12. Arrival statuses

The statuses “I’m on my way”, “I’m here” and “I’m running late” are temporary and linked to the individual experience. The other participants and the Host may receive the notifications provided for.

13. Board

The event/table board may be readable by all users who are able to see that content. Only booked users and authorised organisers may post, comment, reply or react.

If a user cancels, they lose the right to new interactions; content already published may remain in the history unless deleted/moderated.

14. Chat

Private chat between users is available only when there is a Match or another condition expressly provided for.

The event/table chat is private and accessible to those who have booked and to the Hosts/Co-Hosts. Anyone who joins later may read the previous history for as long as the chat exists.

The chat may include voice messages, reactions, attachments, polls, mentions, pinned messages, translations, read receipts and other features made available.

15. Scheduled messages

The User may schedule a message to be sent in the future. Before it is sent, they may edit it, send it immediately or delete it.

At the scheduled time, the system checks that the User is still authorised for the chat. If not, the message is not sent.

16. Hearts, Matches, mutual liking and See you again?

A Heart expresses interest but does not by itself create a Match. A Match arises only according to the mutual/acceptance mechanism provided for.

Private mutual liking detected in the post-event phase does not automatically create a Match; it may invite the User to voluntarily send a Heart.

17. Evenings together and people already met

Socialeat may indicate how many experiences two users have actually shared. This indication is a social memory and is not equivalent to a Match, Follow or friendship.

18. Reviews and How did it go?

After a valid experience, the User may be invited to rate the event/evening, table, Host and restaurant, when relevant.

Reviews must refer to real experiences and comply with the rules of conduct.

The How did it go? section may keep experiences still to be completed and makes it possible to resume or remove an entry according to the app’s features.

19. Propose the evening again

Propose again makes it possible to create a new event based on a previous experience and to invite the relevant people. The new event is independent and subject to the normal booking, seat, 4-hour, place and cancellation rules.

20. Recommender systems

Socialeat may suggest content using parameters such as interests, area/distance, date, availability and participation history.

When the DSA is applicable, the Terms will be updated to comply with the specific obligations on recommender systems.

21. Plan B

If an event is cancelled shortly beforehand and the system finds a real alternative that is nearby and compatible, Socialeat may propose it.

The proposal does not create automatic bookings. If no valid alternative exists, the Plan B notification is not sent.

22. Maps and addresses

Structured addresses may open third-party map services. An event may be associated with a simple address without being linked to a restaurant.

The Host remains responsible for the choice and appropriateness of the place. Map services are also governed by the terms of the relevant provider.

23. Content and intellectual property

The User retains the rights to their own content and warrants that they are entitled to publish it.

By publishing, the User grants Socialeat a non-exclusive, free-of-charge licence limited to the operations necessary to host, display, adapt to format, transmit and share the content in accordance with the requested features.

Any further external promotional uses must be governed clearly and in accordance with the rules of the service and the applicable legislation.

24. Prohibited conduct

25. Reports, moderation and complaints

Socialeat may remove or restrict content and accounts on grounds of law, security or breach of the Terms. Measures must be proportionate.

26. Blocking users

Blocking restricts interactions in accordance with the rules of the Service. Socialeat may prevent notifications, chats and other interactions between blocked users, while preserving the technical data necessary for security/moderation.

27. Notifications and e-mails

Operational communications include bookings, reminders, messages, waitlist, event changes, arrival statuses and other actions requested by the User.

Promotional communications are separate and subject to the applicable preferences/consents.

28. Third-party services

Socialeat may integrate maps, app stores, authentication, sharing, translation and other third-party services. When the User moves to a third-party service, the provider’s conditions and notices also apply.

29. Updates, minimum version and availability

Socialeat may update the Service for security, compatibility, fixes or improvements and may require a minimum version of the app when necessary.

Interruptions and maintenance do not prejudice the mandatory rights granted to the consumer.

30. Price of the Socialeat Customer Service

The use of Socialeat Customer is free of charge. Some events may provide for a participation fee set by the Host and payable directly in the app: the fee goes to the Host through the payment provider and Socialeat does not retain any commission. Any future paid feature will have to be preceded by specific pre-contractual information and by an update of the Terms.

31. Liability

Socialeat’s liabilities are governed by law. No clause limits rights or liabilities that cannot be excluded with respect to the consumer.

Socialeat is not liable for the independent conduct of users or restaurants beyond what is provided for by law and by the obligations inherent in the service.

32. Account deletion

The User may delete the account through the flow available in the app and/or the channels actually provided. The consequences for data are described in the Privacy Notice.

33. Changes to the Terms

Substantial changes will be communicated clearly and with the required notice. When a new express acceptance is necessary, it will be requested before continuing to use the features concerned.

34. Applicable law and competent court

The mandatory rules protecting the consumer and the competent court provided for by consumer legislation remain unaffected.
